1. Reservation/payment
You are requested to reserve your chosen tour or course in writing, using the above form. Early booking makes our task a lot easier and guarantees a free place for you. Your reservation must be received at least 60 days before the beginning of the tour/course. In making your reservation, you implicitly accept our General Terms and Conditions of Business, which are an integral part of the contract between you and the mountaineering school. This also applies to reservations made orally or by phone. After we have received your reservation, you will receive a written confirmation, the detailed programme and a list of the necessary equipment. We kindly request you to make the payment indicated in our confirmation without delay. For a later reservation, the total amount is due immediately.
2. Programme changes
Our courses and tours take place under all weather conditions. However, we reserve the right to modifiy the program or, in particular, the route according to the conditions. In signing this agreement, participants confirm that they accept this principle. Any additional costs will be charged to the participant; in the case of lower costs, the difference will be refunded to the participant.
3. Insurance
As a mountaineering school which is approved by the canton, the organizer is covered by a comprehensive liability insurance. Otherwise participants are not insured by the organizer. We recommend taking out adequate sickness and accident insurance. Don’t forget to take out insurance against cancellation or postponement of your holiday.
4. Prices
The services included in our prices are listed under each offer. Participants who are not members of the Swiss Alpine Club (SAC) are requested to pay the warden of the cabin directly for their overnight stay.
5. Contract cancellation (anouncement of non-participation)
5.1 Cancellation by the customer
Cancellations must be made in writing. The cancellation takes effect on the date the organizer receives it. In any case, a handling fee of CHF 100.00 will be charged and we will also charge you the following costs (as a percentage of the package price): on receipt of the cancellation notice up to 120 days before departure, the deposit paid, up to 90 days before departure 70%, up to 60 days before departure 90%, thereafter 100%. For trips that are carried out despite not reaching the minimum number of participants according to the announcement, there is at no time a possibility of a refund. Any postponement of a reservation counts as a cancellation of the tour/course which has been booked and as a new reservation for another tour/course. No reimbursement will be made in the case of a participant’s premature withdrawal from or interruption of a tour/course.
5.2 Cancellation by the organizer
Should there be too few participants for a particular tour or course, or should circumstances beyond our control (e.g. weather conditions, safety considerations or rules imposed by the public authorities) render it impossible to run the tour or course, the organizer may withdraw from the agreement at short notice. If the participant is unable or unwilling to switch to another tour or course, he or she will be reimbursed the amount paid, minus the cost of any services already rendered. Any further compensation is excluded.
6. Liability
The organizer is responsible for any defaults in the running of the tours or courses offered, insofar as the default concerns failure to perform the agreed services, or changes that result in a performance which is inferior to that originally agreed. However, the liability of the organizer shall in no case exceed the amount agreed for the tour or course in question and shall only apply to direct damages. The organizer shall not be held liable for prejudice and damages of any kind suffered by the participant if these were not due to an error on the part of the organizer or one of his assistants. The organizer shall only be held responsible for the actions of the tour/course leader if the latter failed to exercise his or her function as tour/course leader correctly.
7. Organizer
Unless indicated otherwise, the organizer is the Swiss Mountaineering School Alpine Action Unlimited, domiciled in Flims, Switzerland.
8. Applicable law and place of jurisdiction
The legal relationship between the organizer and the participant shall be governed by Swiss law. The exclusive place of jurisdiction for any disputes arising from this agreement is Trin insofar as Alpine Action Unlimited acted as organizer.
